BP gets favorable ruling, Advocate Capital Inc. reports The 5 th Circuit Court of Appeals ruled on 12/2/14 that a lower court judge in New Orleans must reconsider whether businesses seeking payouts from a 2012 settlement really suffered damages that were a direct result of the BP Deepwater Horizon oil spill.  A lower court judge, Carl Barbier , said he only needed to ensure that the administrator overseeing the settlement properly calculated the payments per the settlement agreement, not whether there was causation.  The appeals court disagreed, and has asked the lower court to address causation.
